please let me know, i’m just trying to understand the laws surrounding this
You should be, of course credit the rightful owners or Winnie when selling but yeah don’t worry! 🪿
as long as the pattern writer gives their permission and you give them credit for it, i’m sure you’ll be okay <3
Be careful because Winnie the Pooh is a copyrighted character, so you’re technically not allowed to profit off of it. you can give it away for free though I think, but if you sell it I doubt anybody’s gonna report you to Disney or anything, just be careful!
Technically you should ask Disneys permission first as they own Winnie the Pooh
Disney is known for being quite aggressive at defending its copyright and trademark rights
The original Winnie the Pooh character (no shirt) moved into the public domain, but not the Disney version, which has a red shirt.
You could be liable to Disney for infringement because of the red shirt if the pattern is not licensed.
If the pattern is licensed, then generally speaking, you would be able to sell what you make.
HTH
If you are selling online than no but if your selling it at a market yes
The plush is adorable. Good job. I would not stock a market with them. As a gift, sure.
Making a pattern? Disney says no. We wanted to show a Disney movie at the Senior Center as a fundraiser and they would not let us. Yes, we asked first.
Even if a free pattern is offered it is still no. The one lady offered a baby yoda pattern for free and still got a cease and desist letter from Disney attorneys. She had to rename it and make significant changes to it before she could offer it
Money is not the point. Intellectual property rights are.
it would be acceptable to sell under a separate name, like Honey Bear. I know people do this with Pokemon and other anime characters.
That doesn’t make it legal
They would have to make significant changes to the character to do that
Same thing with Sanrio, Nintendo and other big names. A lot of infringers get away with it. Doesn’t make what they are doing legal.
It just means that they haven’t been caught yet. It could cost them thousands if they do get caught. It would also ruin their professional reputation as crafters if they do get caught
I feel like I read somewhere that Winnie the Pooh wasn’t copyrighted anymore?? but dont quote me. Just quickly google it and then you know!
it’s probably the og version, as this person said:
Very Interesting thankd for the help!
Dang I’ve never actually heard a crocheter getting a cease and desist letter?!
She had to take her pattern down from Ravelry…
because they made a horror movie abt him. I think that Disney dropped the copyright. idk
