Does this count as copyright

So I have the ability to look a any crochet mainly amigruami and make it without buying the pattern, does this count as copyright if I wright down my version of how I did it

I think as long as its a little different it should be fine, though it might be best if its not a paid pattern

As long as you credit who and the original design or who inspired it, and note that it wasn’t your original idea. Then I don’t think it would count as copyright

so my question is: is it copyright to crochet a lisenced charecter as a crochet project and sell that pattern or project like spiderman or dora

I believe if your selling it, it is copyrighted but if your just giving it as a gift then ur good but you can get special permissions to sell it which may involve giving them money

well if i were (for example): crocheting spiderman i could crochet spiderman but as it’s product name could be super spiderdude or something

I get that some ppl do that but i have done a lot of reaserch with this stuff cuz i wanted to do this too, but its rlly important to make sure that you have legal rights to sell it (even if you re-name it) because the makers of the character will see it as taking away sales from their products that they may have made for that character

It is never legal to sell something that is a licensed/copyrighted character. Even if you rename it or change it slightly. Even giving it away for free has risk involved, albeit less risk than if you were to charge. The only exception is ‘public domain’ characters. See the link above for a decent discussion, though the list of public domain characters is out of date. For instance, steamboat willey I believe became public domain (or was it moritmer mouse?) and so did winney the pooh. Hence why they made horror movies of those recently. But you’re always taking a risk unless you get special permission. And I guaranty you’ll have a rough time getting special permission from Nintendo, Disney, Pixar, etc. The big names will charge a lot. I know someone said they paid 2k just to sell at a disney event for disney characters and they had to get preapproval for everything they were selling.

I believe the only version of Winnie the Pooh in the public domain is the original one. Not the newer ones. Could be the same with Steamboat Willie or Mortimer Mouse.

Yes, that’s accurate. It’s because disney’s control over them expired since they’re so old. So it would only be the original (though that would be hard to differentiate in plush form so there could be an argument for pooh products being based on the ‘original’ design)

Also to add, you can’t just credit someone and its immediately considered not copyright. That’s not how that works. You need express permission. There’s a lot of misinformation floating around Ribblr about this but copyrighted/licensed characters do not stop being copyrighted/licensed simply because you change the name or state in your intro that its based on that. Most people saying that likely haven’t taken a business law course. I’ve taken many and can guaranty that is not how it works.

That being said, people take the risk often. A lot of people get away with it and have for a long time. Others haven’t been so lucky and have been sued and their entire storefront shut down permanently. So doing it is always a risk. Doing it for free doesn’t make it legal, it just means you’re less likely to be targeted as you’re not making money off of that pattern. However, they could still come after you as you’re gaining followers which could lead to you gaining revenue from other patterns as a result.
