On one hand I think you’re right, one shouldn’t copy someone else’s work. On the other hand leggy frogs as a crochet pattern are far from an unique idea and everyone and their grandma has already published one 
There are sooo many patterns of them and they happen to be similar. And as far as I can see, these two patterns are worked quiet differently. So I’m not sure if I would count that as copying even if they wanted to recreate the look
