No one has the legal right or the right to Gatekeep a pattern or design that you created on your own. You legally have the right to post it and they cannot legally keep you from doing it as long as the pattern is not the same. As you acknowledged you did not know they exist and that is not your fault. It is that creators responsibility to make sure their patterns speak for themselves. No matter what, you or any other person posts will not determine on how well their patterns do because as it is up to the creators of each pattern to advertise their own work to ensure the best success for their own business. Poster pattern. Do not let this person win by gatekeeping. If that is really something they are concerned about they can attempt to find a lawyer but there is no way any lawyer will take this up as this is not copywriting. You did not steal their pattern. You did not steal their photos. You did not steal their work. They are not the owner of breakfast foods or leggy things. They just so happen to have a similar idea as you did. Because if you ask me if this was an issue then the thousands of other versions of leggy frogs and cows and chicken loafs and cat loaves would already be taken down and only have one original.
Post your work, people clearly love it and those who are willing to stand by you will stay by you. But again, do not let this gatekeeper win. No one has the right to get keep in an art community. Nothing is original twilightâs. Not original. Harry Potterâs not original. Netflix isnât even original. All the furniture and pictures you see none of it are original. Theyâre all variations of something theyâve been inspired by. And again, if they are so concerned about your stuff. Clouding their work. Then maybe they should get off their butt and post it more in a way that theirs doesnât get overshadowed. Itâs not your responsibility to make sure their business thrives. No business will ever succeed if thatâs how every business had a mindset.

Yeah, itâs really weird. If you had made a leggy frog, itâs not like the 1000 other people whoâve made one would come at you. This is the same thing, just with food!!
For what its worth, if its for your mental stability walk away for a little bit. The worst thing that you could do is let this eat away at your confidence.
Its such a fun, unique pattern. Comparing the two, they are different enough - maybe the names were a little close but other than that, what you made shows your creative distinction. It follows your creativity, and your art flair.
There are many patterns that are similar to breakfast buddies, but all are unique and distinguishable to the artist. Im hoping them reacting that way was just out of a brief lapse in judgement. I know as induvidual artists we all hate to see plagarized art. However, claiming shape and integrity = stealing would mean that the vast majority of all patterns are copied, which is not the case.
I would hate to see all this hard work get put away forever, but completely understand taking a small break to recoup. <3

Also the fact that they made their (admittedly different) pattern 2 years ago, I think if Scarlett posted it a month or less after they released their pattern I MIGHT be more understanding, but nothing is truly original and I donât think itâs fair to put pressure on another designer to not release their pattern. Iâm sure if I tried hard enough I could find a pattern that was released before theirs was that was similar in concept and that they wouldnât like a different designer saying the same thing to them
So, are they going to ask every person whoâs ever made something called a breakfast buddy to change their creationâs name?
Because a quick google search shows tens of breakfast buddy crochet patterns.
Same with the style of legs.
Thereâs thousands of leggy patterns now, and thereâs no way they can tell you that you canât use something they didnât even come up with

Iâm so sorry about all this! I wish everybody could recognize that with so many designers out there, itâs impossible to make something that is 100% unique and different in every way from anything else out there.
I just did a quick Google search and all the breakfast buddy patterns I saw all seem like they have different foods aside from some more common foods. And based off the style of legs, Iâm pretty sure I found who youâre talking about, and your patterns seem quite different. A similar concept is definitely not enough to ask someone to take down all their hard work for. I can only imagine how terrible this feels, being accused for something like this especially when itâs obvious how much effort and care is put into each one of your patterns to make them as unique and amazing as usual.
You probably already know this, but I just want to say you did absolutely nothing wrong.
Iâm so sorry that you have been put through this emotional stress. I think the fact they have admitted your pattern is different to theirs shows you should continue.
Imagine the mess fiber arts would be in if every similar designs resulted in lawsuits.
I donât think you should change your pattern, you worked to hard on it.

This is honestly really unfair that this designer is doing this. There are so many crocheters out there, and for another person to have a similar idea for a pattern is just bound to happen! This person is literally taking this too far for a crochet pattern and for her to even threaten to sue you? That is INSANE.
I really hope this all works itself out for you, because nobody deserves to go through this.
I totally agree with this! I have a pattern in my shop (baby cyclops) that has bobble and chain arms. Nobody has ever said anything to me. Admittedly, I have never really done research before creating patterns. I just draw my idea and jump in. In the future I will be sure to do lots of research so nothing like this comes up for meâ
